1. Scope
The General Terms and Conditions (GTC) apply to all our business relationships and purchases in the online shop https://mayer-emi.at/ between us, Mayer EMI GesmbH, Franz Prendingerstrasse 74, 2540 Bad Vöslau, and our customers. The version valid at the time the contract is concluded shall apply. Further provider identification and the authorized representatives can be found at https://mayer-emi.at/impressum.
The customer is a consumer.
Our GTC apply exclusively. Deviating, conflicting or supplementary terms and conditions of the customer shall only become part of the contract if we have expressly agreed to their validity. This requirement of consent applies in every case, for example also if the customer refers to his own GTC during the ordering process and we do not expressly object.
2. Conclusion of Contract
During the ordering process, the desired goods can first be placed in the shopping cart. There the desired quantity can be changed or selected goods edited. Afterwards the customer data can be entered and the shipping and payment method selected. Finally, an overview page is provided on which the information can be finally checked and input errors corrected or edited. If the ordering process is to be aborted, the browser window may be closed.
The representations of the goods in the online shop do not constitute a legally binding offer but an invitation to order. By clicking the Checkout button in the last step of the ordering process, a binding offer to purchase the goods displayed in the order overview is made.
Immediately after submitting the order, an order confirmation is sent in which the customer’s order is listed again and which the customer can print by pressing the “Print” button; this does not yet constitute acceptance of the contractual offer but merely serves as proof of successful receipt of the order. A contract with the customer is concluded as soon as the order is accepted by a separate e‑mail (order confirmation) or the goods have been dispatched.
In the order confirmation, in a separate communication, at the latest upon delivery of the goods or before the start of the performance of the service, the contract text (order, GTC, cancellation policy and order confirmation) will be made available to the customer by e‑mail.
If at the time of the customer’s order no copies of the product selected by him are available, the customer will be informed immediately. If the product is permanently unavailable, Mayer EMI GesmbH will refrain from declaring acceptance. In this case no contract is concluded. If the product designated by the customer in the order is only temporarily unavailable, Mayer EMI GesmbH will inform the customer accordingly.
The language available for the conclusion of the contract is English only.
3. Prices and Shipping Costs
All prices are inclusive of the applicable statutory value added tax.
The applicable shipping costs will be indicated to the customer and are to be borne by the customer, unless the customer exercises his right of withdrawal.
In the event of a withdrawal, the customer shall bear the immediate costs of return shipment.
4. Payment Terms
The customer will be informed of the available payment methods during the ordering process.
The purchase price becomes due immediately upon conclusion of the contract. Payment for the goods is made via one of the payment methods offered in the ordering process.
5. Retention of Title
Until full payment has been made, the goods sold remain the property of Mayer EMI GesmbH.
6. Delivery
Delivery times are calculated from the time of the order confirmation, provided that the purchase price has been paid in advance. Unless a delivery time is specified for the respective goods or a deviating delivery time is indicated, it is 7 days.
Mayer EMI GesmbH only delivers to customers who can provide a delivery address in the following countries: EU member states, United Kingdom, Switzerland.
7. Promotional Vouchers
Promotional vouchers issued free of charge as part of our advertising campaigns (e.g., voucher codes) can only be redeemed in the online shop and only during the specified promotional period. Individual goods may be excluded from the promotion. This results from the content of the voucher campaign.
Voucher codes can be entered before completing the ordering process and will be deducted from the purchase amount. Subsequent crediting is not possible.
Only one voucher code can be redeemed per order. The order value must be at least equal to the amount of the promotional voucher.
8. Right of Withdrawal
Consumers have a statutory right of withdrawal when concluding a distance contract and are informed about this in accordance with the statutory model.

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.
To exercise your right of withdrawal, you must inform us,

by means of a clear statement (e.g., a letter sent by post or e‑mail) of your decision to withdraw from this contract.
After receipt of your withdrawal declaration you will receive from us an RMA number and the return address. The RMA number must be enclosed with the return shipment. Unannounced or improperly labeled returns cannot be accepted.
To meet the withdrawal deadline it is sufficient that you send the notification of the exercise of the right of withdrawal before the withdrawal period has expired.
9. Consequences of Withdrawal
If you withdraw from this contract, we will reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us).
We may refuse the refund until we have received the goods back and have examined their condition.
Inspection and Refund: We are entitled to withhold the refund until the returned goods have been received or until you have provided proof of shipment. After receipt of the goods we will carry out an inspection of their condition; this inspection will be completed no later than 14 days. The refund will be made within 14 days after completion of the inspection, less any compensation for loss in value that may be due. We will inform you in writing of the result of the inspection and any compensation calculation.
You must return the goods to us without undue delay and in any event no later than fourteen days from the day on which you informed us of your decision to withdraw from this contract.
You shall bear the direct costs of returning the goods.
The goods must be returned complete, in perfect condition and in the undamaged original packaging including all accessories, cables, protective films, documentation and other components. Missing or damaged parts may result in corresponding compensation for loss in value. We reserve the right to document the condition of the returned goods (e.g., photo and inspection report). This documentation serves to substantiate any compensation calculation.
A permissible inspection of the condition, properties and functioning of the goods comprises exclusively a short, careful functional check as would be possible in a retail store.
Not permitted within the scope of the inspection are in particular:
– prolonged or intensive use of the device
– use in studio or stage operation
– saving of own presets, data or settings
– integration into an existing setup
– mounting in racks or permanent installation
– any use that leads to visible signs of wear
– damage to the device or packaging
In such cases we reserve the right to reduce the refund amount appropriately.
You are liable for any loss in value of the goods only if this loss in value is due to handling of the goods that is not necessary to inspect their condition, properties and functioning. If the inspection shows that compensation is due, we will deduct the determined amount from the refund. You will receive a statement with justification and documentation (photos, inspection note).

11. Exclusion or Premature Expiry of the Right of Withdrawal
The right of withdrawal does not apply to contracts for goods that are made to the consumer’s specifications or are clearly tailored to the consumer’s personal needs, nor to sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
12. Warranty
The statutory (defect) warranty rights apply.
13. Data Protection
Mayer EMI GesmbH complies with the applicable data protection provisions, in particular the Data Protection Act (DSG) and the General Data Protection Regulation (GDPR).
Specific information on how customer data is processed can be found in the privacy policy.
14. Applicable Law and Jurisdiction
Austrian substantive law shall apply to this contract to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Pursuant to Art. 6(2) of Regulation (EC) No 593/2008 (Rome I), this choice of law does not deprive the contracting party who is a consumer of the protection afforded by the mandatory provisions of the law of the country in which he or she has his or her habitual residence; such provisions shall remain applicable.
15. Alternative Dispute Resolution
We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
16. Final Provisions
Should any provision of this contract be or become invalid, void or unenforceable, this shall not affect the validity and enforceability of the remaining provisions.
